Police Station Advice

In the majority of cases, criminal proceedings begin with the arrest of a person suspected of a criminal offence and their subsequent detention at a police station for the purpose of being interviewed about the suspected offence. Being arrested is often a harrowing experience especially if you have never been arrested before and more so, if you feel you have done nothing wrong.

If you are arrested as a suspect in an offence and are detained at a police station for the purpose of being interviewed, then you have certain rights which include:
  • the right to have someone of your choice told that you have been arrested
  • the right to free and independent legal advice from a solicitor of your choice.

If the police propose to interview you about the allegation for which you have been arrested, then they cannot do so in the absence of your nominated solicitor, if you have exercised your right to representation.

You will not have to pay for our services whilst under arrest at a police station, as the Legal Services Commission, (formerly the Legal Aid Board) will pay our fees.

We believe that you should always take up the right to representation even if you feel you have done nothing wrong.
